Assembly Bill 350 passes Senate Labor and Industrial Relations Committee

On Wednesday, June 29, Assembly Bill 350 by Assemblyman Jose Solorio (D-Santa Ana) passed the Senate Labor and Industrial Relations Committee 5-1.  AB 350 now heads to the Senate Appropriations Committee where it is expected to pass before heading to the Senate Floor for a vote.

Amongst the various arguments in opposition, there was an interesting discussion pertinent to our industry on the issue of background screening and whether or not the bill precludes an employer’s right to conduct a background check to an employee they are absorbing from the prior contractor.  Senator Mark Leno (D-San Francisco), and other members of the committee, requested that Assemblyman Solorio consider amending the bill to clarify that employers have the right to conduct background checks.
