To: CALSAGA members From: William Hodges, Deputy Association Manager Barry Bradley, Bradley & Gmelich, CALSAGA Legal Advisor Re: Court of Appeal issues favorable decision in meal and rest break case Date: July 30, 2008 Last week, the California Court of Appeal issued a favorable decision for California employers, clarifying the obligations as it pertains to meal and rest break requirements. While the decision addresses employer concerns regarding “providing” versus “ensuring” an employee takes a meal break, it does not address the on-duty meal break issue in a fashion that we need, unique to the security industry.
